Commission - Terms of Service

Any statement can be bound to change if discussed with me, the artist, prior to the commission.
The following terms and prices are applicable only for personal, non-commercial work!

I. GENERAL TERMS

  • Available to do portraits, pet portraits, character illustration, character design, props, tasteful nudity

  • Estimated completion time and current queue can be checked here

  • Default drawing size is an A3 page at 300dpi

  • Simple backgrounds are included

II. PAYMENT

  • Stripe (card payment), PayPal, or Etsy

  • option 1 (not applicable on Etsy): half of the payment done before I start working on the commission, and the other half when you receive the final image; the work in progress previews for this option will either be at a very low resolution, or watermarked.

  • option 2: full upfront; the work in progress previews will be at full resolution, without a watermark.

  • the drawing will not be started before I receive the payment

III. PROCESS

  • once the payment goes through, I can start working on the commission

  • I will let you know when I start working on your commission

  • if you commissioned a sketch there will be no Work-In-Progress shots, or initial sketch, only the final image

  • for any other kind of commission, I will send an initial sketch so we can discuss the pose, composition and color scheme

  • after the initial sketch gets approved, I will send you more Work-In-Progress shots, in case you would like to give any feedback on the details

  • after the initial sketch gets approved, big composition or pose changes will cost extra

  • I will do my best to make my commissioners happy, to follow their references and feedback

IV. COPYRIGHT / USAGE POLICY

  • I, the artist, hold all the rights to the final image, not the commissioner, therefore I´m allowed to use the copyrighted artwork to:

    • promote myself with in any place or site

    • publish books with

    • to display it anywhere to my liking

    • post it wherever I want

  • The commissioner is allowed to;

    • use the copyrighted artwork for personal use only, unless agreed otherwise.

    • print the art, and claim the right of their character(s) but not the drawing itself

    • use the art to promote themselves with proper credit given to the artist

  • If you break the copyright infringement in any way, every right you had to the drawing will be retracted. The following is considered Copyright infringement:

    • reproducing/using the copyrighted artwork commercially (meaning making money off it in any way)

    • taking credit for the creation of the image

    • removing any watermarks/signatures

    • altering the artwork without my, the artist´s, consent

    • using it to create AI work

  • A purchase of the Commercial rights to the image is always available

    • this will increase the price of the commission significantly and will be discussed with the commissioner

    • with commercial rights you are allowed to make any sort of merch with the artwork, use it in books, covers, as props, etc.

    • you are also allowed to change it to your liking and promote your own brand with

    • credit is still required for usage of the artwork, even if altered or edited.

VI. CANCELING/REFUNDING POLICY

  • I have the right to cancel and refund the money for your commission at any time

  • if you change your mind before I start working on the image, you can get a full refund (PayPal fees might apply)

  • if you change your mind your mind after I send the initial sketch, but before you receive any other Work-In-Progress shots, you can get a refund equal to half of the original price (PayPal fees might apply); this means, there will be no refund if you chose the half upfront payment method

  • you will not get any refund if you change your mind after you receive any Work-In-Progress shot, besides the initial sketch

VII. PRIVACY POLICY

  • To fulfil your commissions, you must provide me with certain information, such as your (nick)name, email address, payment information and the details of the commission that you're ordering

  • A nickname and preview of the commission type will be always visible on my public commission queue. You can chose this nickname, or I will add a nonidentifying one. No other information will be public or visible, following EU's GDPR laws.

  • Information Sharing and Disclosure: I share your personal information for very limited reasons and in limited circumstances, as follows:Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to respond to legal process or to government requests; Tax and invoicing purposes.

  • Data Retention: I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 4 years.

  • Your Rights

    If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:

    Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.

    Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.

    Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.

    Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
